1. Agreement to Terms
By accessing and using the services of Eurogrounder, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Services
Eurogrounder provides professional construction services including but not limited to residential construction, commercial construction, renovation and remodeling, project management, design-build services, and consultation services.
3. Use of Website
You agree to use our website only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the website. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content or disrupting the normal flow of dialogue within our website.
4. Service Agreements
All construction services provided by Eurogrounder are subject to separate written agreements that outline the specific scope of work, timelines, costs, and other relevant terms. These service agreements take precedence over these general Terms of Service for matters specifically addressed in the service agreement.
5. Pricing and Payment
All prices are subject to change without notice. Payment terms will be specified in individual service agreements. We reserve the right to refuse service to anyone for any reason at any time. Late payments may incur additional fees as specified in the service agreement.
6. Project Timelines
While we make every effort to complete projects within agreed timelines, we cannot guarantee completion dates due to factors beyond our control including weather conditions, material availability, regulatory approvals, and unforeseen site conditions. Any significant delays will be communicated promptly.
7. Warranties and Guarantees
We stand behind the quality of our work and provide warranties as specified in individual service agreements. Warranties do not cover damage resulting from normal wear and tear, misuse, lack of maintenance, or modifications made by others.
8. Limitation of Liability
Eurogrounder shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the services.
9. Intellectual Property
The content, organization, graphics, design, compilation, and other matters related to the website are protected under applicable copyrights, trademarks and other proprietary rights. The copying, redistribution, use or publication of any such matters or any part of the website is prohibited.
10. Changes and Cancellations
Changes to project scope must be requested in writing and will be subject to approval and potential adjustment of costs and timelines. Cancellation terms will be specified in individual service agreements and may include charges for work already completed and materials ordered.
11. Dispute Resolution
Any disputes arising from these terms or our services shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with Greek law.
12. Indemnification
You agree to indemnify, defend and hold harmless Eurogrounder and our partners, employees, and affiliates from any claims, losses, damages, liabilities, including legal fees and expenses, arising out of your use or misuse of the website or services, violation of these Terms, or infringement of any intellectual property or other right of any person or entity.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of Greece, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
14. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our service, and supersede and replace any prior agreements we might have between us regarding the service.
